"It's illegal to annoy"

A new federal law states that when you annoy someone on the Internet, you must disclose your identity. Here's the relevant language.

"Whoever...utilizes any device or software that can be used to originate telecommunications or other types of communications that are transmitted, in whole or in part, by the Internet... without disclosing his identity and with intent to annoy, abuse, threaten, or harass any person...who receives the communications...shall be fined under title 18 or imprisoned not more than two years, or both."

But the law only makes it illegal to annoy anonymously, so unfortunately this mayor isn't covered.

The intent of this statute is already covered under state anti-stalking laws (in most states, it's called something like Harassment By Electronic Device) with language that is much more reasonable.

I can see the logic of making a federal law to handle this (when someone in Wisconsin is harassing someone in Texas, whose laws apply?), but it would have been far more sensible to write it something like:

The recipient of interpersonal communications of any nature shall have the right to file suit against the originator of that communication under statue(s) in force at the recipient's location or the originator's location, at the recipient's option. If the location of the originator is unknown, the recipient may file suits related to the comminication at the recipient's location with the irrevocable right to commute the suit to the originator's location, at the recipient's sole option, when the originator's location is learned.

This would keep the federal government out of the business of trumping state laws. The problem is that some local government could pass an impossibly strict local ordanance and demand that the originator show up in court or face some ludicrous fine. I'm not sure if there is a simple solution to that problem, but the current attempt is incredibly bad law.

Harassment/Stalking is another matter entirely. We're talking about annoying here. I wouldn't even have expected an administration apologist to take a "that's OK" stand. The White House and Congress are using copies of the Constitution printed on toilet paper. But, you're right, it is an incredibly bad law, and shouldn't even make it past one of the circuit courts. If it makes it up to the current Supreme Court, heaven help us.

You know, this story reminds me of when Norway got its constitution (May 17 1814). While they were discussing the paragraphs in April, the danish prince Christian Frederik - soon to be Norway's King - tried to indirectly influence the envoys to add a paragraph about prohibiting anonymous slander. He was very annoyed about people writing to newspapers anonymously and blow their top off to politicians and himself. Well, the envoys didn't include such a paragraph. And we got the 2nd most liberal constitution at the time (after USA).

Since annoying someone anonymouly is now a criminal offense, must the annoyed place charges against the (anonymous) annoyer to obtains " justice " or is there a third party involved, watching every message board, blog, IRC chat room and such for traces of annoying behavior ?

The Annoy-MIBs if you will.

That notion would entail a lot of evesdropping.
