A criminal is one who has committed a crime. have (pathological) tendency to commit (especially more serious) crimes (falling under the criminal law).

I have no idea what that is supposed to mean, but illegally entering the United States of America by any means (including falsification of papers) is unambiguously a criminal act as it can result in six months imprisonment in a federal prison for the first offense, and two years for subsequent, as per the INA.
