Such ignorance on the part of a US Government official (US Senator Lindsey Graham, R-Sc) Graham, a co-author of legislation that would make it harder for a president to fire a special counsel, said it was very important that Mueller be allowed to proceed without interference and that many Republicans share this view. It already IS impossible for the President to fire a Special Counsel. The only basis for having a Special Counsel (AT ALL) right now (and has been for years since the Law on the subject expired) is 28 CFR Part 600 (CFR = Code of Federal Regulations). Here is a link to it: https://www.law.cornell.edu/cfr/text/28/part-600 28 CFR Part 600.7 (conduct and accountability) (d) The Special Counsel may be disciplined or removed from office only by the personal action of the Attorney General. The Attorney General may remove a Special Counsel for misconduct, dereliction of duty, incapacity, conflict of interest, or for other good cause, including violation of Departmental policies. The Attorney General shall inform the Special Counsel in writing of the specific reason for his or her removal. Attorney General Sessions recused himself from being involved with a Special Counsel in this matter... Something about being caught lying about HIS involvement in this matter during his confirmation hearings before the US Senate. So the #2 person at the DoJ (Deputy Attorney General Rosenstein) appointed and has Sole Authority over Special Counsel Mueller. So we couldn't have Sessions involved with Mueller, since Mueller will likely be investigating/have investigated Sessions, and that would be a huge corrupt conflict of interest if Sessions could discipline/fire Mueller... Now, please don't get me wrong here... I am NOT on Trump's side in this. Feb. 28, 2016 The $64 billion question is 'does Trump really believe that tripe'? The common people in the USA that he is appealing to seem to. But the main difference between the two of us in this matter is that I am unwilling to shred what is left of our Constitution to do so. The combination of the Mueller probe and the ratings-hungry news media is quickly turning this into a Constitutional pissing match. There is a Constitutional way to remove ANY Elected or Appointed official in either the Federal Executive branch or the Federal Judicial branch. Impeachment by the US House (simple majority), then conviction and removal by the US Senate (67% majority). The ONLY way to force the early removal of Trump is the Impeachment process. Of course, he could resign, or he could lose his next election (in 2020), or might not even be nominated (in 2020)... But other than that... Impeachment. A sitting President cannot be prosecuted for a crime (or even indicted). So says a long-standing (decades or more) opinion of the DoJ's Office of Legal Counsel. Again, from the CFR: 28 CFR 600.7 - Conduct and accountability. Again the above mentioned opinion from the OLC is a practice/policy of the DoJ. It was invoked on President Clinton in his mess (lying under oath). Therefore Mueller is bound by it... Unless Deputy Attorney General Rosenstein allows him to do so, which would be legally questionable. If that happens, it would be a bad thing... The US Federal Government would be permanently crippled, since no matter who the President was, his/her political opponents would then do some jurisdiction shopping around and find one that would be willing to indict and put him/her on trial... Continuously... No matter what... That would be a bad thing, would it not? Someone on trial with their finger on the 'nuke' button? Total chaos. Much better to just obey the procedure in our Federal Constitution to handle things like this... Here is what I would like to have happen: 1. Rosenstein calls Mueller to his office. 2. Rosenstein asks Mueller if Mueller is going after Trump. If no, then we are done. 3. If yes, then Rosenstein demands of Mueller all the evidence he has on the subject, so far. 4. Rosenstein then ends Mueller's investigation and status as a special counsel. 5. Rosenstein then delivers the evidence to the relevant officials in the US House AND the US Senate. 6. House then impeaches Trump. 7. Senate then convicts Trump and removes him from Office. 8. Massive trial-fu happens on Trump... Without any Constitutional issues. If this doesn't happen, and Trump is dirty, then likely the best for the country would be (asap): 1. Trump resigns. 2. Pence is President. 3. Pence pardons Trump immediately. 4 Since Pence was also on the ticket with Trump and is tainted also... 5. Pence resigns immediately without appointing a new VP for Confirmation by Congress. 6. Paul Ryan (current Speaker of the House) is President. 7. Ryan pardons Pence. 8. Ryan appoints a new VP for Confirmation by Congress. It already IS impossible for the President to fire a Special Counsel. Lol... Tricky Dick Nixon vs. Special Prosecutor Archibald Cox... ROFL. I suggest you do some more reading on that subject. Nixon didn't Fire Cox... Nixon demanded that Attorney General Elliot Richardson fire Cox. He refused and resigned. Nixon demanded that Deputy Attorney General William Ruckelshaus fire Cox. He refused and resigned. Then Nixon demanded that the #3 person at the DoJ, Solictor General Robert Bork fire Cox... Bork reluctantly complied. Of course, then, the S**T hit the fan. Besides, where in the Constitution does it directly give the President the power to fire people? It doesn't. The Constitution DOES directly give that power to Congress (impeachment, etc.) and the Congress has used it. Now then, the impeachment process only applies to members of the executive and the judicial branches. The legislative branch is covered under Section 5 of Article I. By 2/3rds majority vote, the House can expel its members, as can the Senate on its members. Over our history, there have been, I believe 18 impeachments with 8 convictions/removals. Most of those impeached have been Federal Judges, and ALL the convictions/removals have been Federal Judges... But there has been 2 Presidents impeached, one cabinet member, and one US Supreme Court justice. In contrast, there have been 15 Senators and 5 House members expelled over the same time period. Watch Rosenstein stand on Congressional Impeachment, if Trump tries to fire him. And you can rest assured that in his defense he will be presenting ALL of Mueller's goodies, to Congress. It is why I say, end the Mueller probe now, and go straight to impeachment in the House... And don't depend on the Republicans in Congress standing behind Trump either... It is bad enough that Trump did a hostile takeover of the Republican nomination back in 2016... But also, Trump has been peeing in the Congressional Republican's bowls of wheaties since he got inaugurated. I shall reiterate, my objection as is other people's is not what you post, it is little or no consequence to me BUT your manner of posting is very rude, wasteful of bandwidth and an affront to internet protocols.
