I'm referring to all the American people across the country who lost their jobs and were forced to move their families into homeless shelters until even the shelters were turning them away due to overcrowding... Mt. Soledad Cross Subject of Oral Arguments in the Ninth Circuit Federal Appellate Court Tomorrow ANN ARBOR, MI  The U.S. Court of Appeals for the Ninth Circuit will hear oral arguments on Thursday, October 19, which may well decide the fate of the Mt. Soledad Cross. The case involves a challenge to the federal district judge’s May 3, 2006 order requiring the City of San Diego to remove the memorial cross within 90 days or face fines of $5,000 per day. The hearing is scheduled for 9:30 AM, in Courtroom 1 of the Richard H. Chambers U.S. Court of Appeals Building in Pasadena, California. Robert Muise, trial counsel with The Thomas More Law Center, a national, public interest law firm based in Ann Arbor, Michigan, will present oral arguments on behalf of San Diegans for the Mt. Soledad National War Memorial, the organization that launched the highly successful ballot initiative to save the national veterans memorial. The Thomas More Law Center and the City were successful in getting U.S. Supreme Court Justice Anthony Kennedy to stay the lower court’s May 3rd order. Tomorrow, the Law Center will argue that the case should be dismissed based on mootness grounds. A recent Congressional Act, signed into law by President Bush on August 14, 2006, immediately transferred all title and interest to the cross and memorial to the federal government. Thus, as of August 14, the City no longer owns the property upon which the memorial is located. Therefore, the district court’s injunction is no longer enforceable. Moreover, changes in constitutionally significant conditionsâ€â€namely, the vast improvements made to the veterans memorial in 2000 and its subsequent designation as a national veterans memorial by Congress in 2004â€â€plainly warrant reversal of the district court’s order to remove the cross. The May 3rd order was based on a constitutional challenge to a stand alone cross and not a constitutional challenge to the present veterans memorial, which requires a different legal analysis. Robert Muise, commented, “The stay by Justice Kennedy and the recent Act of Congress are significant factors that have shifted the momentum of this case in favor of preserving the memorial cross. We are hopeful that this Ninth Circuit panel will preserve this historical war memorial for future generations of Americans. 'No discrimination' in veil row A Muslim classroom assistant suspended by a school for wearing a veil in lessons has lost her claim of religious discrimination at a tribunal. Aishah Azmi, 23, was asked to remove the veil after the school in Dewsbury, W Yorks, said pupils found it hard to understand her. The tribunal dismissed her claims of religious discrimination and harassment on religious grounds. But Kirklees Council was ordered to pay her £1,100 for victimising her. Ms Azmi, a married mother-of-one, said she would be appealing against the decision to dismiss her religious discrimination claims. In a statement she criticised ministers who had intervened in the case and said it made her "fearful of the consequences for Muslim women in this country who want to work". She said: "However, I am pleased that the tribunal have recognised the victimising way in which the school and the local education authority have handled this matter and the distress that has caused me." 'Mark of separation' The case attracted comments from Prime Minister Tony Blair, who backed Kirklees Council for suspending Ms Azmi. Mr Blair said the wearing of a full face veil was a "mark of separation" and made some "outside the community feel uncomfortable". The government's race minister Phil Woolas demanded Ms Azmi to be sacked, accusing her of "denying the right of children to a full education". Ms Azmi, who is originally from Cardiff, said: "Muslim women who wear the veils are not aliens, and politicians need to recognise that what they say can have a very dangerous impact on the lives of the minorities they treat as outcasts. "I will continue to uphold my religious beliefs and urge Muslims to engage in dialogue with the wider community, despite the attacks that are being made upon them." Headfield Church of England Junior School, which has 546 pupils, suspended Ms Azmi because it said pupils found it hard to understand her during lessons. Kirklees Council said the decision was taken after a monitoring period in which the impact of wearing the veil on the teaching and learning was studied. It said: "In this case the school and local authority had to balance the rights of the children to receive the best quality education possible and Mrs Azmi's desire to express her cultural beliefs by wearing a veil in class. I understand that the start of all of this was a few months ago when the assistant was teaching a class of children without her veil. A male school teacher walked in to speak to her and she put on the veil. He asked her to remove it so that he could talk to her properly, and she started her actions of complaint from this point. Who said what, when, is now incidental since this case is being picked up as the test case as to whether a woman can be asked to remove a veil to make for proper communication. It is also true that nowhere in the religion of Islam does it state that a woman must wear a veil in the presence of a man not her husband or otherwise. It is an interpretation chosen by some Islamic women, and an interpretation forced on some Islamic women. We have a situation in the UK where 'outsiders' are coming into the UK and are in the process of establishing their ways as being rights which must be imposed on all in the UK, to supersede the existing rights, for example, of proper communication without veils over our faces. flaming balloons |
