A federal judge ruled that the District of Columbia and Maryland may proceed with an unprecedented lawsuit against President Trump alleging that Trump’s business dealings have violated the Constitution’s ban on receiving improper “emoluments,” or payments, from individual states and foreign governments.

The ruling, by U.S. District Judge Peter J. Messitte in Maryland, marks the first time that a lawsuit of this kind has cleared the initial legal hurdle — a finding that the plaintiffs have legal standing to sue the president in the first place.

In this case, Messitte found that D.C. Attorney General Karl A. Racine (D) and Maryland Attorney General Brian E. Frosh (D) have legal standing to sue Trump over the business of the Trump International Hotel in downtown Washington.

As part of that ruling, Messitte said he rejected an argument previously made by critics of the lawsuit — that, under the Constitution, only Congress may decide whether the president has violated the emoluments clauses.

“In absence of Congressional approval, this Court holds that it may review the actions of the President to determine if they comply with the law,” Messitte wrote.

If you want to get Trump out of office, great! Fine by me, I didn't vote for him... But look elsewhere than this.

Yes, the President can be sued while in office. We have Mr. Clinton to thank for that from a SCOTUS case when HE was getting sued over him being a horndog with Paula Jones. Mr. Clinton did not get impeached over that case. He got impeached (obstruction of justice and perjury) over lying under oath to a grand jury over that case. If Mr. Clinton had just stood up in front of the press and declared "Yes, I did have relations with her (and a few other women since then too), but it was consensual!" He would have gotten off scot-free as well as being at least slightly a hero in a somewhat sick way to a lot of men.

Mueller needs to either defecate or vacate. He has been going for almost a year, and has indicted a bunch of people already (a total of 101 counts across 19 people and 3 organizations). If he does have something on Trump, Mueller needs to turn it over to Congress so that Congress can start the Constitutional process of impeachment, 'conviction', and removal from office. If he doesn't, its time for him to quit. If he has nothing so far, but keeps going anyway then he is just playing politics. Mueller is authorized to investigate Russian efforts to influence the 2016 election, and any links between the Trump campaign and the above Russian efforts. That is pretty much it... It is not an unlimited fishing expedition.

MK of course you can take the 5th in a civil case. You can even take the 5th in voir dire or a deposition. In a civil case, unlike a criminal one, the Jury will get to hear you state it and they will form whatever opinion they will. So if you get asked 100 questions, 100 times the jury would get to hear, "On the advice of legal consul I respectfully decline to answer as I might tend to incriminate myself." Of course you will have to answer if the sky was blue before you came into the building or face contempt.

If it wasn't just internal talk then you have evidence of obstruction of justice.

Mueller will be all over this and the grand jury will be busy issuing true bills.

I hope that Mueller keeps looking, but not because I've predetermined what he's going to find. Instead, much like what we're doing here, finding nothing can be just as important as finding something. If he is able to continue investigating unhindered, if it is not proven that Donald Trump had any part of any provable conspiracy to interfere with the election, then this will increase confidence in him and his administration. His approval rating is rising, a sign of increasing confidence. (Yes... I know the only important poll is the ballot box, but still...)

And, perhaps Mueller will find something unexpected... maybe a corrupt Democrat or two, who knows? I hope he investigates both sides of the aisle, and independents; everyone who needs to be. All leaders should be so closely scrutinized: it keeps them (more) honest. It's a small price to pay compared with the billions a disastrous corrupt administration can cost.
