The problem is what she HAD on her own email server.

No, the problem is if her personal email server distributed classified information to a person not authorized to have that information. Doesn't matter if the person the information was distributed to was a hacker/criminal or not, just if a distribution happened.

You see it is a vanishingly small number of people who are allowed to walk out of a government building physically (includes electronic form) carrying classified information. When they do there are special rules about how they are required to protect that information. If it isn't on their person it must be locked in a safe, and a safe on the approved equipment list. I don't think Clinton's email server was on the approved list, so if information leaked, she is at fault. Also at fault for not immediately reporting the leak of information. Also at fault for not discovering there was a leak. As this hacker/person isn't a US citizen, that fact should be enough to convict her of espionage, not just the lesser charge of mishandling information.

I see some federal grand jury testimony in this hacker/person's immediate future. I see a request for a bill going to this grand jury in a short time too. Crystal ball is a bit cloudy if a bill is returned.

Your thinking seems to suggest that any leak will end up as a espionage charge so why has there not been people charged when there's leaks and hacks of other government departments after all even if it official equipment if there hacked and some time has gone buy then the head of whatever department should be charged even if they didn't know it happened till somebody else knew .

It has also been stated that the department has known of the Clinton network for a long time, but did not check its security.
And as has been pointed out some of these documents were made classified post date, a point others have also questioned.
One of the supposed classified documents was a copy of the public announcement made 24 hours earlier. How can a public announcement be classified? If you know the answer to that, there are many people within government and military circles that would like to know.
And there also has to be questions of the people who authorised the release, and transmission classified documents to an insecure location.

I'm not saying the Clintons are innocent, but there are an awful lot of questions that need to be asked of other parties about what they knew and why proper procedures were not followed. Not only concerning Hillary but also previous holders of the position.

It certainly isn't a black and white case, it's probably several hundreds of shades of grey.

As I said it looks like a witch hunt that will backfire . Not so much with the election but I mean with charges being laid . Those that are calling for the investigations may be the ones that end up with the charges against them even if she loses the election .

Because it is your duty to know that and report immediately if it happens.

Software must log how many times a given file is read from the disk and who read the file. You need to review this log to be sure it matches what is reported from the people accessing the file.

Handling TS/SCI is not like handling general information, there is an extreme level of paranoia required. But if you have never worked in a facility that has "hello" phones, you could not begin to understand.
