How very nice to see you on this thread, what a truly pleasant surprise! :]]


I'm sorry to have been away. I'll do an update soon but very briefly: Dad's will went missing, the lawyer who drafted it went missing, the intended executor had also disappeared! So I've been hunting high and low. My good news today is that I found the lawyer; he's starting a case in Washington DC and won't be back in Canada until Friday, but at least I've now found him. :]]

I've also had a lot of banking to deal with, and have a good friend to help out on a tricky legal situation. So it's been hectic, you know?

But I look forward to getting some of my troubles solved and spending some pleasurable time with you guys (and lady) either here or on Rocky's Cafe.

Thanks ever so much for thinking of me!

Today's update:


Well, as I said below, I found myself in a very awkward position. Dad's Last Will and Testament had disappeared! The lawyer who drafted it dropped out of sight. The intended executor couldn't be found.

I'm embarrassed to even tell you all this, I can imagine what an idiot this makes me look like. But I'm doing it because I'm blogging on this topic of "What Happens When Your Last Parent Dies" (among other reasons) in the hope that those of you who haven't gone through it will learn from my experiences.

Lost the Will, lost the lawyer, lost the executor...how can this happen to a father and son who are both lawyers?! Well let me start by saying that if it can happen to me, it could happen to you, too. So let me explain how this came about.

I lost touch with my very experienced and successful Estate lawyer because as he became more successful, he became harder to reach. My first mistake was in thinking that I could always easily locate him.

Well that just isn't always the case with your lawyer, not when you're talking about a lawyer rising in his profession. You see the legal world for the last 10 years has been responding to globalization. The largest law firms are going international, merging with other firms and starting law offices all over the world. So they are becoming more and more like multinational corporations, the big fish gobbling small fish. They also do their best using head-hunters to steal the top lawyers away from each other.

The last time I tried to contact John (let's call him that), I couldn't. He had left his last law firm for a better partnership position with a bigger firm. The law firm he had been with misled me, they acted as if he had retired. They didn't want me to follow John to a competing law firm. I can't say that they outright lied, but they did a very cleverly worded spin job of misleading me into a wrong impression. John hadn't left the profession, he was just taking a brief vacation and then relocating to the new firm. When I called the Law Society (Bar Association) they simply hadn't kept up to date in keeping their records. So it looked like John dropped out of sight. No luck with his home number either. He had bought a bigger house, and finding himself very busy, he had changed his telephone numbers and even gotten his personal name delisted from the telephone directory. So I was looking for him in a period of transition. These are happening more and more to good lawyers while all this global jockeying and expansion is going on.

But how does someone trained as a lawyer and his lawyer son lose a Last Will between them? Easier than you might think. Like most people, we agreed that the Will would be kept in Dad's safety deposit box. He even made a point of taking me with him to the bank to see him place it there. But what happens is this: as people grow older and think more about what will happen after they die, they start to fret about their will. Is everybody covered? Did they remember to give their friend So-and-so that personal item they would so much enjoy and remember the deceased over? ...and so on. So they go to the bank and take the Will home with them, to go over it. In many cases you see, there are several small gifts or "Bequests" in a Will, several conditional executors, beneficiaries and so forth. The Will is several pages long and you can't go through it standing next to your safety deposit box, it just isn't convenient. When you think about it, Testators (Will makers) often change their mind (and their Wills) by amending them with additional codicils as their feelings about people change too, or because they've remembered someone else they wish to treat. The problem is: the Will often doesn't end up being taken back to the safety deposit box. I'll bet you any number of Wills get mislaid that way.

The same with the executors. They retire, they die, they become ill, they move, they leave the country...for one reason or another, they become unable or unwilling to act as executor for the Will. You just can't expect people to remain in place 10 years later.

So what's to be learned from this? People's situations change, so once a year you should locate the lawyer and the executor, and check with your parent to make sure of what's what, any codicils, and who is where. You'll save yourself a lot of aggravation that way.
