But if the IRS get in first such a pre-nup might actually end up with Melania being due more than t.Rump's net worth - now that would be a bit of poetic justice (or injustice depending upon one's point of view). It was solicited after Mr. Nixon left office as up until that time no one had ever had to seriously consider the possibility of bringing charges against POTUS. The opinion, is only binding on prosecutors working for, with or under DOJ. It does not exist for prosecutors from the 50 states who are free to do as they please.
