Chikwature was jailed for 12 weeks for driving with excess alcohol, and 26 weeks for dangerous driving, to be served concurrently.
IMV, sentence was too short.

Whole cloth for murder, big reach for manslaughter, because for either you have to show some mental state to cause harm and a jury isn't going to bite absent serious injury, but reckless endangerment of the child fits and with that unfit parent potential loss of custody.

But drink driving court isn't family court.

In the US we have involuntary manslaughter, but because it is involuntary you can't attempt it.

Involuntary manslaughter arises where the accused did not intend to cause death or serious injury but caused the death of another through recklessness or criminal negligence. For these purposes, recklessness is defined as a blatant disregard for the dangers of a particular situation.
Thanks, that was more or less what I was thinking of. In this case, it was a blatant disregard & what is worse is that a vodka bottle was found in the car - who's to say she wasn't also drinking on the journey down?

With her demonstrated attitude to the laws of the road would she admit to drinking on her last journey.
Whatever the custodial penalty she serves the person I really feel for is the young kid. Either her son will spend the time in jail with her, which is not the best environment for a child at this stage in their development, or will be "housed" by social services, possibly in a foster home, and separated from his mother. Neither is desirable :-(

All because his mother didn't think of the consequences as she downed the Vodka the night before then set off on the journey that ended in the accident the next morning.

I've seen people from 20-80 that don't have the emotional maturity to be allowed to operate any sort of vehicle or machinery. Yet somehow they've managed to get a license.

It must have been about 30 years ago (?) there was a programme on TV, from either the BBC or ITV- people trying to get their licenses, after numerous tries & failures. I remember one woman who'd had dozens of attempts to get her license, and finally got it.
While I felt sorry for them, none of them should ever have been given a license.

If a person can't get it after 2 attempts, then they shouldn't be allowed to try again for at least 12 months (probably better 18-24 months). If they still can't get it after having that time to (hopefully) mature after another 2 attempts then that should be the end of it. Driving just isn't for them.

I got My drivers license at age 19, in one try, I scored 99 out of a possible 100, on both the driving test and the random written test, here in California, dad paid for Me to learn how to drive, plus I got time in His car a 1972 Mercury Marquis Brougham, a 4 door sedan(painted yellow), it was His way of making up for the lack of child support(mom wanted only $12 a year for support, Dad would send $20 to Me for Xmas), both before the divorce from My mom, and after, it turns out I had a half sister(named Dorothy), and He was Her dad too, mom would have divorced Him in an instant, if She had ever known, My cousin, My brother, and My dad all knew this, it was an open secret I was told, but no one told Me until everyone else was long gone, now that same cousin's wife is suffering w/everyones 'favorite' bugaboo, Alzheimers, My cousin is 83 this year, I wish Him and His wife Grace well.

I passed my driving test first time after 8 lessons, in 1963 aged 18, in a Morris Minor 1000.

I too learned to drive in a Morris Minor 1000 and got my license in 1962 at the age of 17. That was quite a car, I wish I had it today even though I'm not sure what I'd use it for. Maybe it would attract women?
