In America to prove slander one has to prove that the person that slandered you 1. harmed you 2. was WRONG. LOL....What would the judge require if he were to sue? |

In America to prove slander one has to prove that the person that slandered you That's libel, btw. (It's published, see?) It has to be evident as a real assertion of fact: something that's obviously false is not libel. If a male friend of Scott's pulled that as a practical joke, it's probably not libel. If Scott's estranged wife hired the plane and added the words "...- Mrs. Scott Kelly" to the banner, it might well be. As to number 2., truth is a defense to libel. So, the poor schm**k would have to pull it out in open court as evidence, I guess. LOL Some lawyer I know (I'm not saying who) once defended a client for contempt of court, who, while leaving the courtroom, muttered "What a Jerk!" in reference to the presiding Judge, while he was passing the security guard at the door. One of the defenses was, that his assertion was true! (The lawyer didn't like that Judge, you see). LOL Actually though, he was acquitted on the basis that the Crown could not prove that he was doing anything but muttering to himself. |

I called it slander because I don't guess that a sign or banner is published. But I don't know. After all, how many cases involving airplane signs have gone to court? |

Years ago in the British Army, at the turn of the last century, one of the charges that the squaddies could be brought up on was "silent contempt". The scene painted above would have fallen into that category. I believe, JC, it was known as "Dumb Insolence". |

Years ago in the British Army, at the turn of the last century, one of the charges that the squaddies could be brought up on was "silent contempt". The scene painted above would have fallen into that category. And if the mescreant could not be caught on that charge, there was always a follow-up charge of "Conduct to the prejudice of good order and Military Discipline, contrary to Section 69 of the Army Act 1955". [edit] This was a 'Catch-all' section. It could be manipulated to mean ANYTHING. |

I called it slander because I don't guess that a sign or banner is published. But I don't know. After all, how many cases involving airplane signs have gone to court? Hey! No Biggie! LOL But for what it's worth, if it's spoken by a person live, it's slander. If it's in text or media, consider it "published", ie libel. The banner is printed text, as distinguished from spoken word in person, so it's libel. A broadcast TV comment? Libel, even if "spoken" because it's published/broadcast. |

Having defended quite a number of men charged under Sec.69, I have often wondered if the people who drew up the Manual of Military Law did not, in fact, have a sense of humour after all. Because with this clause you were 'f***ed' whichever way up ..... ! |
