Update Having read the article, I consider it possible that with one shot in the hand the attacker could have whirled around and then been shot in the back by a second round fired in quick succession by a frightened and inexperienced person. One possibility, albeit not the only one. At some point in time it will have to be determined whether or not citizens have the right to defend themselves from attack and it will have to be taken into consideration that the average citizen facing attack is not trained as a police officer or soldier would be trained. And before you think that I am a right-wing nut consider this: I am a screaming liberal who believes in socializied medicine, etc., etc., but I still reserve the right to defend my own self and the selves occupying my home. I would shoot anyone invading my home and reserve the right to defend my property as well in an appropriate manner. I will do whatever it takes to defend my family. One thing that troubles me is the prosecution of people by those seeking higher political office - we must seperate prosecutions from the electoral process. There should be some other way to select these officials - otherwise prosecutions will continue to be based on political convenience as opposed to the search for true justice. One should be mindful of all those convicted in a dubious manner and subsequently proven innocent - consider the Innocence Project - and include those convicted and who have then continued to be imprisoned even after others have confessed to those crimes. To the victor goes not only the spoils of war but, more importantly, the bias of history. |

Update Defense of the home against an invader is very clear cut in every jurisdiction I have heard of. If someone breaks into your house while you are there, and they are armed, you have the right to shoot them. The difference is the kids were on the other side of the street on someone else's property. This is NOT defense of the home. BOINC WIKI |

Update If, indeed, you are correct and the person shot was not even on the shooter's property then the game changes and self-defence would not appear to be an option, especially if the deceased person was unarmed. To the victor goes not only the spoils of war but, more importantly, the bias of history. |
