Classified documents from Biden’s time as VP discovered in private office

CNN — Several classified documents from President Joe Biden’s time as vice president were discovered last fall in a private office, Biden’s attorneys acknowledged Monday.

Attorney General Merrick Garland has asked the US attorney in Chicago to investigate the matter, a source familiar with the matter tells CNN, and congressional Republicans are also taking notice.

Biden’s lawyers say they found the government materials in November while closing out a Washington, DC-based office – the Penn Biden Center for Diplomacy and Global Engagement – that Biden used as part of his relationship with the University of Pennsylvania, where he was an honorary professor from 2017 to 2019.

Fewer than a dozen classified documents were found at Biden’s office, another source told CNN. It is unclear what the documents pertain to or why they were taken to Biden’s private office. Federal officeholders are required by law to relinquish official documents and classified records when their government service ends.

There's a key difference between the classified documents found at a former Biden office and the ones Trump kept at Mar-a-Lago, national security expert says.

....Former President Donald Trump immediately pounced on the story. "When is the FBI going to raid the many homes of Joe Biden, perhaps even the White House?" he posted on his social media network.

But Bradley P. Moss, a national security lawyer, told Insider that so far this looks like a routine matter with no allegation of criminal wrongdoing. He contrasted what we know about the case with that being built against Trump, who held boxes of classified documents at his Mar-a-Lago resort even after their return had been demanded by the National Archives.

"Biden's team did exactly what you're supposed to do," Moss said. "When you find improperly stored classified documents, you immediately notify the government — and you turn it over immediately."

Classified documents are routinely misplaced, and so far this looks to be a routine investigation, perhaps motivated in part by a desire by the Department of Justice to show it is impartial, Moss said. The nature of the investigation would change if the US attorney in charge of reviewing the documents, Matt Lausch, a Trump appointee, were to uncover any evidence that Biden or his staff misled the National Archives.

"The reason Donald Trump is in criminal jeopardy right now isn't just because of the documents being improperly stored. It was the obstruction," Moss said. "That is why it has gotten to the point it has, where we're looking at the real possibility of a criminal indictment."

WASHINGTON — Attorney General Merrick B. Garland on Thursday appointed Robert K. Hur, a veteran prosecutor who worked in the Trump administration, to handle the investigation into how classified documents from President Biden’s time as vice president ended up at his private office and home.

Mr. Hur, who previously served as the U.S. attorney for Maryland during the Trump administration, is responsible for investigating “the possible unauthorized removal and retention of classified documents or other records discovered” at the office of Mr. Biden’s think tank in Washington and his residence in Wilmington, Del., according to the order signed by Mr. Garland on Thursday.

Second Set of Classified Documents Found at Biden’s Wilmington Home

WASHINGTON — The second set of classified documents from President Biden’s time as vice president were discovered at a storage space in the garage of his home in Wilmington, Del., a top White House lawyer said on Thursday.

The Times reported on Wednesday that this second set of documents had been found at a location “associated” with Mr. Biden. On Thursday the White House statement offered more detail by specifying that the location was his private residence, where he often spends weekends.

The White House statement, by Richard Sauber, a special counsel to Mr. Biden, did not answer fundamental questions about the contents of the documents, who packed them and whether anyone had gained access to them after he left office. It also did not say when the second batch had been found.

Yep, there's a big difference between the 2 cases. Like night and day, good and bad, law abiding and criminal.

...Some 300 classified documents with classification markings, including some marked “top secret”, have been retrieved from Mr Trump’s home since he left office in January 2021.

In January 2022, the National Archives told the Justice Department that boxes of documents they had already received from the former president contained a lot of classified material. This led to the August 2022 search of Mar-a-Lago by the FBI in which agents discovered 33 boxes containing some 11,000 documents including 10 marked classified.

While the Biden team immediately alerted the White House counsel’s office, who in turn contacted NARA, when those documents were found, the Trump team was less forthcoming, with months passing by and a protracted battle to retrieve further documents.

There is no indication that Mr Biden had any knowledge of the existence of the documents and they were quickly turned over without any attempt to delay or hide the discovery.

Mr Trump has engaged in an extended argument that he had declassified the material and had every right to hold on to them. He could face potential charges relating to obstruction and is not immune from prosecution now that he has left office....

But also a little sad that a president could be held accountable for only the job he is doing and also duties for the same.

I guess it should be for the Constitution here, except both the Attorney general and also the U.S. Senate telling when it should be any wrong.

Just legal for any legislative, and it becomes the judiciary when a criminal investigation, so always business to do when someone could be doing their work.

Only that a secret could be for the clandestine when also a couple a papers or documents that rather should be hidden for their revealing contents.

Should tell that I do not understand the U.S. Constitution for its open meaning.

But if Area 51 could be still a secret, also papers for such a thing, except that we are not told about that either.

Last time a president had to go was Nixon, for the secret tapes he recorded while communicating with his employees or staff members, for the scandal it also became.

The fact is that when just hired, you could be still carrying out your job, except that it should be for a clandestine meaning.
