Donald Trump’s legal hot water continues to heat up. Special counsel Jack Smith sent a target letter to the former president last week, and an indictment could come within days.
Smith has reportedly notified Trump that he could be charged under three statutes. The most widely anticipated of the charges is for obstructing an official proceeding — Congress’s certification of the 2020 election results on January 6. A second charge, attempting to defraud the United States, likely relates to Trump’s collection of fake elector certificates, which he pressed Vice President Mike Pence to adopt in order to subvert the Electoral College.
These charges both relate directly to the events of January 6. But the third charge could go further. Smith reportedly will accuse Trump of violating Section 241 of Title 18 of the U.S. Code, which makes it a crime to “conspire to injure, oppress, threaten, or intimidate any person . . . in the free exercise or enjoyment of any right or privilege secured to him by the Constitution or laws of the United States.”
The provision, originally part of the Ku Klux Klan Acts of the Reconstruction era, aimed to protect Black voters from intimidation and physical violence. The KKK’s power has faded since then, but the law remains a vital safeguard against all forms of election subversion, as my colleague Sean Morales-Doyle explains. It has been used to prosecute public officials who attempted to omit valid ballots from a vote count as well as private actors who sought to coerce or bribe voters. Just this year, a Twitter user who gave deliberately false voting instructions to divert votes from Hillary Clinton in 2016 was convicted under Section 241.

On Sept. 9, 2015 — three months after Trump announced his bid for president — the tech blog BoingBoing.net published a New York Times article from 1927 that reported that Donald Trump’s father, Fred Trump, had been detained at a KKK rally on Memorial Day weekend. According to the article, “1,000 white-robed Klansmen marched through the Jamaica neighborhood, eventually spurring an all-out brawl in which seven men were arrested.”
Among those arrested, the article identifies a man with the name and address of the home of Trump’s father in Jamaica, Queens. The article details the charges filed against six of the men.

Now there is some irony.

All over America I have met countless numbers of Trump supporters who appear to sincerely believe that Donald Trump really did get more votes than Joe Biden and was cheated out of office. That is one of the tenets of faith that solidifies his bedrock of support. How will these people react when they hear detailed evidence that Donald Trump knew there was no evidence of electoral fraud? That he was told again and again, by his trusted inner circle, that he had lost the election?

Can their faith withstand the weight of the evidence the prosecution will bring to court?...

... Its is such a cliché to describe events involving Donald Trump as "unprecedented".

But what other word is there is to describe the prospect of a US presidential candidate running a re-election campaign at the same time as being prosecuted for attempting to subvert the results of the last election?

Many Americans, but certainly not all, have only one news source, and will never understand the evidence against Trump. Many others don't know anything about much of anything that goes on not only in the United States, but anywhere else as well. They just hear sound bites, and immediately believe them, as they are in line with what they want to think. Actual evidence will never get through to them. I deal with this at work, but not only for this particular situation, but many, many topics. It is extremely difficult to cut through the nonsense many of these people have been fed for so many years. When asked questions, they can't answer them and just refer to the talking points they may have heard. Fortunately, there are people who search for information, and care where it leads them. Unfortunately, there are not enough of these people.

Huuuh, I've already asked this question in the gun violence forum: Was it always like this? Or is it a newer phenomenon that has arisen in the last 10...20 years. In the past, the media, newspapers and TV stations served to provide the population with neutral (the journalistic ethos) information. Newspapers had to earn credibility and readership through reliable, neutral reporting. This reputation had to be proven daily in order not to lose buyers (readers). In social coexistence in villages and towns, there were respected, prominent personalities who were better educated and often opinion leaders, such as pastors, judges, teachers, professors, lawyers, doctors, councilors and mayors... We took a wrong turn somewhere in the recent past, which has led to the current situation.

The problem is money. News sources can first tell people how to think, then continue to reinforce those ideas regardless of evidence otherwise. All the while attracting and holding viewers who want to think in the same way. It's big business selling people what they want. As an example, when Fox News first called Arizona for Biden, their viewers went berserk, and Tucker Carlson actually had a fit, and told the network that they were losing viewers because of a technically correct call, but that didn't match what viewers were told to think. In some cases, actual truth can be dangerous once people have been conditioned to accept a different reality. They built a business on distorted, or actually false news, and kept selling it. Follow the money.

Unfortunately, once the tiger of misinformation has been let loose, there is no (easy) way to put it back in the cage.

I still have my doubts he'll see a day of jail. He'll probably end up with some suspended sentence nonsense and continue as if nothing had happened. He may even be re-elected (and if he is will immediately pardon himself of every Federal charge, which is to say... everything worth anything) because although he tried to overthrow the federal government (among other things), Joe Biden despite leading a record-setting stock market and strong economy and passing two historic bills with unprecedented bipartisan support (plus many others) from his decades of experience, stammered and stumbled a couple of times (being 80 and all), and also has a (D) after his name so is clearly unfit for office. :^p

Wish I was kidding about the possibility of this coming to pass...
