Every presidential candidate runs on change. And every president in the past 80 years has asserted executive authority when Congress has not moved on something they feel is needed. In that sense, no change there at all.

Regarding SCOTUS -- when Roberts was allowed in (before the idea of pushing Senate rules to their current paralysis level), in hearings he talked about building consensus. He stated he wish to avoid the appearance of SCOTUS being a partisan entity. During his first year or so, that seemed to be his intent. I think Scalia and Alioto 'got to him' though, especially with the election of Obama. As a result, the decisions there have been much more of the 5/4 partisan nature. In this sense it doesn't matter if Kagan is 'center' (she's not), center-left (I think that would be more accurate) or 'left' (she's not) -- since she is one of the token 4 in a 5/4 split.

In the past year or two, it has been very clear that decisions of the court have a decidedly partisan texture and will continue in this regard with the current court. You have what increasingly looks like a core TeaPublican group (Scalia, Alioto, Thomas, and Roberts), plus one Republican who is 'voting with his party' increasingly. That is all it takes to make decisions.

Well, we can definetly see change in how President Obama is handling things as they occur now-a-days, if that's how we want to define "change."

And it seems to me that when you say things like "the SCOTUS has a 5/4 'TEAPUBLICAN' majority" that you have a shifted view of what is left and what is right these days.

Do you think supreme court justice Elena Kagan is at the center of the political spectrum now?

As to hope and change -- what surprising mantra for a Presidential campaign. Do you think McCain ran on more of the same? How about Romney -- well not sure about the hope thing, but regarding change -- he's demonstrated change in his own political positions so many times that we can certainly expect more change from him.
