My bank(Bank of America), Will be disputing the charge as My card has the VISA logo on It, As I was told It will be a Flagged as It's an unauthorized transaction and when It is done processing I will get a Temporary credit back to My account, The card wasn't skimmed of course(I always maintain a watch on It, they run It and It's handed back to Me and I don't use an ATM if at all possible, only if I really need to and I keep all My receipts and dispose of them later, I was commended on only having this one happen to Me, So I must be doing something right), It was the place where I get My powdered whole eggs every month, The place notified Me that a whole bunch of numbers were stolen from their servers and that they have since fixed the problem on their end, Me I canceled the old card and ordered a New card, the old one will now deny any new charges of course, The $44.99 was from Carfax in VA and was entered by hand(manually BofA told Me, I contacted Carfax by email too, No phone number, sounds like they don't want to phoned), Someone wants to buy a car on My dime, There will be an investigation by BofA I'm told. I just wish I knew when this will be over and when I'll get My money back from this theft for good, As I need It to pay the rent with.

It was still info from where I get My eggs, As the pin number isn't used online in the places I've been to and I've never seen the cvv used offline, Some online places use the cvv and some don't at all, Can a different name be used with a number? Oh well I'll find out soon one way or another. Oh and the retailers out here don't allow any attachments to their machines on the scanning end, It's bad for business, Bank ATMs, yeah, But then Banks are not too vigilant I'd think, I had to once tell the local manager that I didn't like My card number printed in the open for all to see on the receipts, that was changed the next month. I have always found that banks are pretty good at trying to make their customers happy. After all they make their money from you. As long as you report it timely, they will take action and usually refund the lost money. Key is reporting it timely. Several years ago my wife gave her ATM to a baby sitter so she could get her some cash. She never asked for receipts and when she fired the sitter she never asked for the card back. Well the sitter took over $8,000 from her account over a period of about 6 months before she noticed. The bank only refunded the last 30 days worth because she had not reported it.

Unless the store has sufficient electronic protection in place (really good firewall for starters) the cash register and card scanner can be hacked so that all card numbers with pins and full stripe information are sent to crook central. The mere fact that you have an unauthorized transaction on your account is evidence that the card number was stolen somehow. Probably skimmed at some card reader someplace.
Yes, do file a police report (even though it is < $50 and you are probably going to get your money back from BofA.
BofA is extending the same policy that its Credit cards have to its Debit cards as a gesture of goodwill, not because they have to. Legally a debit card has much lower protections than a credit card, and it does not matter what it says on the front. But please note that BofA is not putting the money back in your account during the dispute, in a credit card dispute the disputed portion of the bill would just not get paid.

There has been a gang in California targeting gas stations with skimmers like this. They can fool most people and are small enough to never show on a surveillance video so the gas station owner hasn't a clue he is being hit.
As to the card type, it is a debit card. Debit cards have no legal protection for fraud. Credit cards do and you can always not pay the bill on a credit card. Many banks do provide protection for debit cards but they are not required to do so and may do it in "temporary" form. I've heard horror stories where the bank claims after investigation the card was really used when it wasn't.

I work in a tremendously seedy part of town and have had my wallet lifted 4 times in 21 years of employment here. Let's see, there were two very accomplished pick-pockets... well actually "pick-purses" if you want to get technical, one mother in drug "recovery" who managed to find my hidden wallet when I stepped out of my office to photo copy some information for her, and one extremely clever young man who stole a secretary's master key and rifled several offices in one day. You know how some people just manage to be victimized over and over because they have absolutely no street sense? Hello - that's me!
Anyway, Bank of America took care of everything every time. I know that people are very down on big banks right now, but I am a completely satisfied customer of BofA. I have found BofA to be very service oriented and very, very understanding. Hang in there Victor. I'm sure the problem will be resolved soon, to your complete satisfaction.

Yeah I've heard and seen the those skimmer on TV, But never in person out here and from what the site You linked to said their pretty thin and only stuck on with adhesive tape.
I'll see what BofA does, so far It's still processing, Maybe after Midnight I'll go look at the BofA website and see if anything has changed at all yet, I may call My two Senators and complain to them too, I'd call My Congressional elected representative, But I don't think He'd do anything except say, We can't do anything about this and they say something as to why they can't or won't usually.
There was a gang operating very near you http://laist.com/2010/03/08/sheriffs_deputies_bust_id_theft_rin.php that if I'm reading the news story correct, was able to place the skimmer inside the normal card reader so it was undetectable by eye. That is scary stuff. Don't know if the cops got all the gang, or if there were more who just decided to move their operation a bit to the east.

In the UK we have had sporadic outbreaks of skimmers in hole in the wall cash machines (ATM's) but the big one was about 2 years ago, when nearly all Shell garages (gas stations) had a problem with their on-counter card readers. They had to change thousands of them out.
I only have a debit card NOT a credit card. If the debit card gets stolen or the details are mis-used, they can only get what is in the bank account it is linked to. In my case not very much indeed! A credit card can be used up to the limit given to it, maybe many thousands of pounds/dollars, before it is discovered lost or stolen.
OK, fraudulent purchases, bankruptcies, non delivery of goods etc are covered by Visa card purchases, but you are usually liable for the first so much, or until you inform the bank its lost or stolen. I prefer to keep my debit card and minimal funds in its associated account. My main funds are safely in a deposit account which I can top up from. For really large purchases i.e. a car I'll write a cheque (check).
The rules are different in different places. In the US, a debit card can clean out your account, and then start racking up fees for withdrawls from an ampty account (no limit at all), and no protections enforced by law. Credit cards have a $50 limit on liability for the customer (normally waived by the bank). Many banks (but not all) treat debit cards and credit cards the same.

Hi John, that is interesting info. The way forward for maximum protection then seems to be to use a debit card in the UK, and a credit card in the US. What about other countries, Canada, Australia, Germany etc ?
In Spain you can get money with your debit card only if there´s enough money in the bank on your account. If you need more, you have to negociate with the bank the conditions (extra credit limit) and fees before.
With credit cards the conditions are different. Usually you have a standart credit limit assigned which you can modify depending on your needs/wishes. Fees are usually expensive.
