DIANA INQUEST: IT’S A £10m FARCE!
The truth stays hidden as key French experts dodge giving evidence to coroner

Exclusive to the Daily Press

THE inquest into Princess Diana’s death is set to descend into farce as two French experts with vital information will be shielded from giving evidence.


Last night’s revelation will outrage those who believe the French authorities are sabotaging the £10million inquest a decade after Diana and lover Dodi died in a high-speed car crash in Paris.


They did not compel paparazzi witnesses to give evidence by video-link.


Now it seems unlikely they will act to ensure the inquest jury hears evidence in person from forensic pathologists Dominique Lecomte and Dr Gilbert Pepin.


Lecomte conducted the postmortem on driver Henri Paul, while Pepin tested his blood.


Their findings – that Henri Paul was drunk – are central to the theory that the crash was no more than a tragic accident.


A legal source close to the inquiry said last night: “We face the probability that the most important forensic experts will avoid giving evidence.


“How is the jury supposed to reach any reasonable and balanced conclusion when it is not allowed to see witnesses speak for themselves or have their evidence crossexamined?


“The testimony of these witnesses goes to the very heart of how Diana, Dodi and Henri Paul died.


“We have already had the farcical situation of the paparazzi – who are the critical eyewitnesses to the crash – not being compelled to give evidence.


“If this situation is allowed to continue, it risks making a travesty of an inquest.”


Earlier one of the legal representatives advising the scientists told the Daily Express: “There is no guarantee that they will even give evidence, and they will enjoy the full protection of the authorities in France if this happens.


“They feel sure they can get away with offering limited evidence at the very most, which might amount to nothing more than their paperwork being shown to the jury.”


Katharine Witty, director of press to Dodi’s father Mohamed Al Fayed – the man who has brought about the inquest – reacted angrily yesterday, and said the French threatened to compromise the integrity of the investigation.


She said: “Mohamed Al Fayed has always said that all witnesses of whatever nationality need to appear in person so that the jury can hear the evidence for themselves with the benefit of cross-examination.


“Anything less than that sells the process short in pursuing the truth of what happened that night.”


Other sources believe Lecomte and Pepin are especially reticent to go through cross-examination because such “serious doubt” has been cast on their methods.


As recently as last year there was fresh scepticism that the Ritz security manager Henri Paul was more than three times over the alcohol limit when the Mercedes carrying Diana and Dodi ploughed into the 13th pillar in the Pont d’Alma tunnel in August 1997.


In August 2006, a full nine years after the accident, Thierry Betancourt, the deputy chief judge at Versailles, near Paris, ordered fresh depositions to be taken from Lecomte.


The judge accepted claims that there were serious inconsistencies and omissions in the scientific paper trail that led French police to conclude that the crash was caused by Paul’s drink-driving.


Documents showed that Lecomte testified on oath that she had taken just three blood samples from Paul.


Yet a log book showed five samples were taken, suggesting the extra samples may have been wrongly attributed to Paul.


Pepin said one sample he tested showed Paul had 1.74 grams per litre of alcohol in his blood, but his finding is not supported by paperwork. A second blood test gives two widely differing readings.


While such inconsistencies were later blamed on “genuine, unavoidable errors”, such claims have failed to end lingering doubts.


Betancourt’s inquiry followed complaints from lawyers acting for Paul’s parents and for Harrods’ owner Mohamed Al Fayed.


Mr Al Fayed has claimed that Diana was murdered by MI6 on the orders of the Duke of Edinburgh. He says Henri Paul’s blood tests were tampered with to cover up the plot, which he says was hatched to prevent Diana marrying Dodi, a Muslim.


Soon after the inquest started at the Royal Courts of Justice, the French authorities were accused of “subterfuge” and attempting to protect the paparazzi . Jack Straw, the Justice Secretary, was urged to intervene and persuade the French government to compel witnesses to give evidence.


Yesterday, however, there was no indication that he has done anything of the sort.


The request came after Lord Justice Scott Baker, the coroner, told the inquest that a “political” decision had been taken within the office of the French Minister of Justice not to compel witnesses to attend.


He said that the French authorities were concerned about the aggressive nature of cross-examination.


They were citing fears for “public order” if the paparazzi were to give evidence by video link.


The court was told that at least six photographers who were at the crash scene had not been issued with summonses.


Michael Mansfield, QC, who is representing Mr Al Fayed, said: “If there is going to be no revelation by the French on the basis on which a political decision has been taken, we say, on the face of it, it is subterfuge.”

The Paparazzi live witnesses evidence cannot be videotaped? They cannot be oredered to appear? The most important forensice witness are not to appear to testify in person??

Welll...okay, you could wear it zipped down to the waist indoors, and I didn't say you can't slip it down to use the loo, now did I. With all those zips on it that should be easy enough. It comes in different colors, so you can wear a different color for every day of the week. :]
