The President is doing exactly what he was elected by the majority of the States to do. I disagree with those who believe that ignoring the fact our immigration system has no way to verify incoming persons from some countries are who they say they are.You really need to look at case law to see how much of the "Immigration and Nationality Act of 1952" has been struck as unconstitutional. You do know this was adopted over President Truman's veto. Harry Truman wrote: Today, we are "protecting" ourselves as we were in 1924, against being flooded by immigrants from Eastern Europe. This is fantastic. ... We do not need to be protected against immigrants from these countries–on the contrary we want to stretch out a helping hand, to save those who have managed to flee into Western Europe, to succor those who are brave enough to escape from barbarism, to welcome and restore them against the day when their countries will, as we hope, be free again....These are only a few examples of the absurdity, the cruelty of carrying over into this year of 1952 the isolationist limitations of our 1924 law. |

You really need to look at case law to see how much of the "Immigration and Nationality Act of 1952" has been struck as unconstitutional. Section a, b, and c, were indeed found to be unconstitutional, by a Conservative SCOTUS in 1954 and 1957 respectively. These sections dealt with spouses and children, applicants convicted of misdemeanors and crimes of moral turpitude and those afflicted with TB. The objections of President Truman were in support of those fleeing Europe due to Soviet encroachment and oppression and seeking to join our way of life not destroy it. This is a different world. Many of those now seeking admission to our society wish to establish enclaves of separate belief systems and laws(Sharia), not to become a component of the 'Great Melting Pot' that is the basis of American Society. I firmly hold the opinion that all should be allowed to worship whatever deity 'floats their boat' or not believe if that is their FREE choice, and as long as that choice is not FORCED on others. We've seen enough religious fanaticism here, Jonestown, the Branch Davidians, and other lesser known groups have wrought havoc on innocent lives through religious intimidation, we don't need more. Again, Trump is acting with Imperialistic Orders in the manner taught by that self-described Constitutional Scholar Barack Obama. The only thing that will stop the swing back and forth from Imperial Leftist Policy Orders to Imperial Rightist Policy Orders is an Originalist SCOTUS that enforces the Constitution as written, not interpreted by the Justice du jour. I agree on the Originalist point. But I would also add 'strict constructionist (both laws and the Constitution)' as well. Laws and the Constitution need to be taken literally... AS WRITTEN... with NO 'discovery of hidden rights/meanings/etc.'. It says what it says, and ONLY what it says, with word meanings interpreted based on the meaning of the words in use when they were written. If there is still a question, then go back to other writings by the persons that wrote the thing to determine meanings. Drain the Swamp. Go back to the Legislature negotiating with each side to enact laws not pouting, lying (and crying) on the floor of the Senate and being intractable. The purpose of the Presidency is to 'Preserve, protect and defend the Constitution from all enemies both foreign and domestic' not write the laws. The purpose of SCOTUS is to determine the validity of laws within the framework of the Constitution AS WRITTEN, not to legislate from the bench. The purpose of the Legislature is to conceive, fashion and enact the laws, not abdicate that duty to either of the other branches(as has been the case for almost a century). As Trump said the time for empty talk is over, those in Congress who do not perform the duties they were elected directly to do by the people will be replaced. By the People.
