Jury blames Big Bad Railroad

How in hell can the railroad be held responsible for the other people's stupidity?
That is beyond ridiculous.

Welcome to jury selection, where smart people figure out how to get off serving.

Clue #1, no owners representative on site. Never heard of any filming where there wasn't an owners representative present. But hey, I live near Hollywood so maybe I know too much to serve on a jury.

If the railroad had granted permission for the shoot, they would have had someone there to talk to the trains. They did not grant permission, therefore the entire movie shoot amounted to criminal trespass.

Plaintiffs apparently claimed two earlier trains went by the site and didn't report the movie crew to their dispatcher. My response is, the movie crew wasn't on the track then and the train crews had no way to know they would be on it later.

I know, but my point was from the film production side. Every below the line person who has ever worked on a location set has bumped into an owners rep at one time or another. Not finding one, every below the line person knew, or should have known, they were trespassing.

I found an article that quoted several such people who wondered and asked about that and were reassured they had permission and that no more trains were expected.

Sounds like the alarm bells were ringing and the back of neck hairs raised, but just not loud enough.

It is ridiculous to only have one key holder. I think someone is in need of more training.

Driver writes off brand new Ferrari

Some people have more money than sense...

Unfortunately, he didn't collect a Darwin award as well.

I'd hope he gets charged with Dangerous & negligent driving, Driving without due care, etc, or all of the above.
At the very least, Incredible acts of stupidity.

EDIT- it's a shame fines aren't based on ability to pay.
$1,500 for someone on part time casual rates will take them years to pay. Spare change for someone who can get an almost $500,000 car.

Plus drugs and alcohol tests.

I bet his insurance company will "love" him.

As for fines - if it can be proven that he was exceeding the speed limit then the fine is related to his income:
From April 24, 2017:
Band A – This refers to the lowest level of speeding. For example, you could be driving at between 21mph and 30mph in a 20mph zone, 31mph to 40mph in a 30mph zone, or 71mph to 90mph on a 70mph road. You can expect 3 points on your licence, and a fine of around 50% of your weekly income.
Band B – This is for more serious cases of speeding. If you're in a 20mph zone and you drive at 31mph to 40mph, or in a 40mph zone at 56mph to 65mph, or up to 100mph in a 70mph, that'll be a Band B fine. That means 4 to 6 points on your licence, or disqualification for between 7 and 28 days, plus a fine of 100% of your weekly income.
Band C – This is for the most egregious speeding. If you're doing 41mph or above in a 20mph zone, 51mph or above in a 30mph zone, or above 100mph in a 70mph zone, that's a Band C fine. That means 6 points on your licence or disqualification for between 7 and 56 days, as well as a fine of 150% of your weekly income.

So do I. Republican politicians would never go for it.

Unbelievable stupidity

Yes, but whose stupidity? Says there is a work zone on the track nearby. I bet that means the track is speed restricted. Did they change the signal barriers for the new lower track speed limit?

Whether one is hit by a train at 10mph or 50mph, it's gonna hurt.

Yep, and encouraging people to cross by putting the gates down 10 minutes before they need to be down ...
