Why? Simplest reason of all. He went to a lawyer and asked him what was legal. Doesn't matter if the lawyer is right or wrong. As long as you don't intend to break the law you are not guilty, mens rea.

If we can justify the prosecution of the leaders of the Nazi state,
but not leaders any other state like it, then the graves of all the
victims of history shall still cry out for justice!

It is easy to see how this could happen. These people have been
practising on their own populations since the revolution that formed
their union. It is difficult to square the wonderful qualities of all the
many friends and relatives we have in the republic, with this terrible
need they display to protect their war criminals.

When it comes to international law there is only one overruling principle: "Might Makes Right". Such is the way of the international order.

And sure, the US pulls off stuff like this, but you can be damn sure that there isn't a single country on this planet that wouldn't do the exact same things if they had the military and economic dominance the US has. For what its worth, the US could behave a lot worse. They could act like Russia or China.

I wasn't going to make a comment here but then I decided that a certain point needed to be made.

Are all of you absolutely certain that the leaders of your country have never done such things in the name of national security? Or have you considered that in most countries no investigation would have ever been commissioned, let alone a report written.

Especally if those in some place at some time cry so load on whole world about their "principles" and enforce their "ideals" to whole other world with brutal force.
Pay should be done, reputational risk would be high in this case (of course if some reputation would left before this revelations ;) ).

no it doesn't make it right ...

They don't understand that ALL Leader's, of ALL Country's, during a War, commit horrendous crimes.

MOST European Leaders, after 9/11 - Aided, Abetted, or had Knowledge, of ALL that has been disclosed. This was an attempt to protect Their People. This is information, related to me, from those who were there.

Therefore... FIRST START Criminal Actions against European Leaders, their Foreign Minister's, Intelligence Agency's, and Military Personnel.

Why not?

They are equally responsible.

Our federal Attorney-General George Brandis, and former Howard Government minister at the time of this era, was heckled at a Human Rights Awards ceremony last night by our own Guantanamo Bay detainee David Hicks for having full knowledge of the CIA were doing at that time.

Brandis quietly left the stage without comment.
