Every cop has to think every person he approaches is guilty until proven innocent. If he doesn't one time, just one time, the cop will make a widow. The code is "officer safety" and it trumps all laws and covers all cop shootings. It is a very ugly concept, but the police unions fought very very very hard to make every court in the land swallow the bilge and they won.

As to habius corpus, well, that happens in courts, not on the street. In this case it happened eventually.
