Evidence does not support civil rights charges.

Police Officer in Ferguson Is Said to Recount a Struggle

WASHINGTON — The police officer who fatally shot Michael Brown in Ferguson, Mo., two months ago has told investigators that he was pinned in his vehicle and in fear for his life as he struggled over his gun with Mr. Brown, according to government officials briefed on the federal civil rights investigation into the matter.

The officer, Darren Wilson, has told the authorities that during the scuffle, Mr. Brown reached for the gun. It was fired twice in the car, according to forensics tests performed by the Federal Bureau of Investigation. The first bullet struck Mr. Brown in the arm; the second bullet missed.

The forensics tests showed Mr. Brown’s blood on the gun, as well as on the interior door panel and on Officer Wilson’s uniform. Officer Wilson told the authorities that Mr. Brown had punched and scratched him repeatedly, leaving swelling on his face and cuts on his neck.

This is the first public account of Officer Wilson’s testimony to investigators, but it does not explain why, after he emerged from his vehicle, he fired at Mr. Brown multiple times. It contradicts some witness accounts, and it will not calm those who have been demanding to know why an unarmed man was shot a total of six times. Mr. Brown’s death continues to fuel anger and sometimes-violent protests.

AN explanation, disregarding those Vile Bigots who state either the white person has to be a racist, or the black person has to be...

YOU are the Person, who a Very Large and Powerful Male assaulted, and attempted to kill inside your car, he attempted to get your gun, possibly to kill you. Why else would he reach for your gun? (Scientific Forensics tends to agree with this story).

The Large and Powerful Male then flees, after suffering a gun shot wound inside your car.

He turns, then 'Bull Rushes' (according to witnesses) YOU! Would YOU now reasonably believe YOUR Life Is In Danger. Of course YOU would. Why else would the Large and Powerful Male be doing this? Of course, to AGAIN attempt to take YOUR Gun to kill YOU. Forget Hollywood Fantasy's: Would YOU have a reasonable chance to Physically Subdue this Larger and Powerful Male? The Real World Answer is NO. YOU are within seconds of being killed.

What would YOU do.

Where is Race involved? No where. We are doing a decent job of Marginalizing The KKK. We now have to Marginalize the Anti-White Bigots.

Note: The above scenario is just one possibly. Why was it disregarded?

Note#2: The Officer may have committed a Criminal Act. Why the 'Rush to Judgment? My Answer - Other Agenda's. Not a search for The Truth'.

Note#3: Try not to ascribe Sane, nor Reasonable Actions, regarding the person killed. People do 'Lose Their Minds' at times.

Just to add a bit...

Also from that NYT news story you linked:

In September, Officer Wilson appeared for four hours before a St. Louis County grand jury, which was convened to determine whether there is probable cause that he committed a crime. Legal experts have said that his decision to testify was surprising, given that it was not required by law. But the struggle in the car may prove to be a more influential piece of information for the grand jury, one that speaks to Officer Wilson’s state of mind, his feeling of vulnerability and his sense of heightened alert when he killed Mr. Brown.

Police officers typically have wide latitude to use lethal force if they reasonably believe that they are in imminent danger.

The officials said that while the federal investigation was continuing, the evidence so far did not support civil rights charges against Officer Wilson. To press charges, the Justice Department would need to clear a high bar, proving that Officer Wilson willfully violated Mr. Brown’s civil rights when he shot him.

The account of Officer Wilson’s version of events did not come from the Ferguson Police Department or from officials whose activities are being investigated as part of the civil rights inquiry.

To reprise events:

Person reaches into police car through open window and attacks police officer, causing injury to the officer (cuts, scratches, bruises and broken bones).
During struggle person attempts to seize police officer's firearm.
During struggle, the officer's firearm discharges inside the police car twice, injuring the person in the arm.
The person backs off a distance.
The police officer exits their police car and orders person to halt.
Person stops, turns around, and starts approaching the police officer again.
The police officer again orders Person to stop.
Person continues approaching the Police officer.
Police officer considers their life to be in imminent danger.
blam-blam-blam-blam-blam.
Person dies.

The above events are supported by not only sworn testimony,
but also forensics evidence and witness statements.

The only possible crime I see in these events is Person's initial attack on Police Officer.

I hear that the whole St. Louis area is back in a state of emergency,

http://news.yahoo.com/ferguson-missouri-remains-edge-ahead-grand-jury-report-120219032.html,

and that gun sales are booming there,

http://www.cbsnews.com/news/ferguson-missouri-gun-sales-to-first-time-buyers-surge-ahead-of-grand-jurys-decision/,

as the population awaits the outcome of the grand jury's report into the incident that sparked riots there back in August.

Activists, authorities and the family of Michael Brown called for calm Friday as a grand jury drew closer to an announcement in the Ferguson police shooting. But a spokesman for St. Louis County's top prosecutor said the panel is still in session.

OK, back to the story that started this thread.

I know that the woman received a $1.5m payout and the cop finally resigned, but I never heard if charges were actually laid against him, does anyone know?

Cheers.

Those that riot, loot, and worse. Without knowing the full evidence, are...

Why would you ever think it is about evidence?

It is about the man doing a horrible thing. Either horrible thing is rubber stamped or horrible thing is verified. Either way there is a riot. It is a lose lose situation.

Riots, looting, burning building's, burning police cars, I-44 cut off.

McCulloch Gives Bizarre Press Conference, that was the icing on the riots.
KKK, was also in Ferguson.

What were they thinking handing out a non indictment so late in the evening.???

McCulloch, and Wilson, have a # on their heads. Maybe 1 year or ten years from now, one will be taken out. IMHO.

They were thinking it is getting cold enough to keep some of the crowds down. They were thinking most people are home for the evening and not going to be trapped by riots.

The laws in Missouri pretty much give a free pass to the police. That is really quite common. Cops get to kill if they feel like it with little liabilty. That is the law.
