Meanwhile back in California; California Highway Patrol investigators have seized the medical records of a woman seen on video being repeatedly punched by one of its officers on the side of a Los Angeles freeway. Why do they need her psychiatric medical history? They are grasping at straws on this. Remember when they say medical records are private the are lying. NEVER seek help for a mental health problem it can and will be used against you. |

Meanwhile back in California; They know they are in deep and are looking for anything to smear her. Remember when undercover cops were doing a sell and bust in NYC? A guy they tried to sell to didn't like drug dealers and when he started fighting them they killed him. They reported he had a juvenile offense as that is the only thing they could find. So much for sealed records. I can understand something happening in the heat of the moment but when it gets organized and thought out we have big trouble. |

In the NYC incident the blame has shifted from the police to the EMTs. The EMTs did not do CPR or give him oxygen. 4 EMTs have been suspended. The real blame lies in 16 ounce sugar water drinks Bloomberg wanted outlawed. How long does one expect to live weighing in at 400 pounds? |

Seem silly to request medical records. They apparently have nothing to do with the Officer's actions. Really. So how many bruises and where has no bearing on the case against the officer .... Oh the outrage, the doctors kept her mental records in the same file, so they must be trying to smear her. A warrant. That means there is a judge somewhere who thinks the records are pertinent. As to smear, it is well past the 72 hours and she still is in a mental hospital, I'd say we know what the result of the 72 hour hold was. |

Chris Arevalo, executive administrator for psychiatric services at Los Angeles County-USC Medical Center, confirmed that the CHP served a search warrant Tuesday for medical records. LA County-USC, 13th floor is where she would have been taken in custody. Since she has been in custody before, they might have some "past" records. Harper said the CHP took files that included statements to her doctor about how she was feeling and references to her attorney. Attorney? Did she have an attorney in any of the other cases? As cash strapped as LA is, she would have only met her Public Defender the morning of her court date. Not going to be in her "past" medical file. Sounds very much to me as if they were after the "current" records. Besides, this wasn't served on Dr. Skid Row, out patient services. Once they got this warrant, they foreclosed the possibility of going after her. If they had charged her, and she asserted a insanity defense, then they get all her medical files. If she didn't assert, then they can't have any. Since they now have something they aren't entitled to, the fruit of the poison tree kills any chance. So it has to be the cop they are planning on going after. Her attorney is mad because he just lost his private records for the civil suit which he hasn't even filed yet. He would have only had to fork over tiny bits in discovery on that and could have hidden troves of material that would have harmed his case. Now his big personal contingency payday got tiny. |

Aren't law suit awards tax free because they are not profit but replace a loss like an insurance payment? If the money replaces a loss, like paying a medical bill, hers will be zero no bill for in custody treatments, then it would not be taxed. If it is to pay for her lawyer, then it is taxed (and he pays taxes too.) Homeless and mentally ill, I doubt she gets loss of income. That leaves pain and suffering and punitive, they don't pay for a loss so they are taxable. California tax 12.30% + Federal 39.6% = 51.9% tax. |
