I'm sure they do, but i'm also sure 'Do you like taking pictures up women's skirts?' wasn't one of the questions.

If he is sacked as a marshal he can always get a job with the TSA, then he can grope them instead....

This stuff is happening all the time but no one asks how it works. I suggest any woman who cooperates while a camera or cellfone is being pointed is posing. But also a camera mounted on a shoe isn't quite hidden. And without a flash just what shows up on the image? Or is it the flash that gives them away?

I assumed this was the usual light banter no one takes seriously.

A background check consists of looking for criminal history and verifying the answers to some specific questions of the 'have you now or have you ever' variety of current jokes.

It tries to determine drug use but does not judge alcohol use except at the top secret level. At the TS level the issue is not so much moral character but questionable judgment. If the guy gets falling down drunk, talks his head off but never about anything classified there are no concrete grounds so it becomes a matter of judgment.

There are the usual good character questions however if the neighbors and co-workers were not wearing skirts how would they know?

On top of that I remember one local case of this and unsurprisingly there was no law against it. It isn't even a civil matter as the person cannot be identified even if the photos were made public.

If it is not illegal background checkers don't give a damn except at the TS level.

does anyone really think there are any squeaky clean in every respect people in the world?

One questions the existence of a federal law against it. This guy is in trouble only because of the 'bringing the agency into disrepute' clause in all employment contracts.

If I were his attorney I would raise the full body scans and claim correctly it is less invasive than the government already does and therefore cannot constitute disrepute.
