Washington State to Tax Marijuana.....

I am curious what others think. Washington State announced that it was going to make marijuana dispensaries charge sales tax and pay B&O taxes. Yet on their DOH page in the FAQ it says dispensaries are illegal. Can a state actually tax an illegal substance? On the DOH website in FAQ the following: Quote: Are dispensaries legal? No. The law does not allow dispensaries. The law only allows qualifying patients and designated providers to possess medical marijuana. Could the state be aiming for a tax evasion angle to add to whatever charges are laid against someone caught selling? No, they sent out notices to over 90 dispensories demanding sales tax and B&O because our Governor spent all our money. A bunch were shut down a couple months ago and were allowed to open a couple days later. The news shows them all the time and they don't try and hide at all. One is right behind the Federal Courthouse. They are real serious about the taxes, I just don't understand how they can tax something they say is illegal even if they are turning a blind eye. Can a state actually tax an illegal substance? I know the Feds do, income tax wise. They also disallow any deduction for costs. |

Texas has the same thing. Marijuana requires a tax stamp. Marijuana is still very illegal here. So asking for a stamp gived the county and state a very good idea who they should tail and issue search warrants on. I wouldnt read to much into this But isn't the tax stamp up to the individual to get? That is different from a business accepting sales tax and paying B&O...The tax stamp is to stop a tax evasion penalty on top of the drug charge. Arizona came up with it the year they screwed up trying to bust people for tax evasion and ended up with cops helping control the crowds at the Superbowl while people were selling Marijuana. Was kind of funny watching cops be crowd control for marijuana sellers.... Official Abuser of Boinc Buttons... And no good credit hound! |
