They would probably win, and to gain financial recompense, the school governors would in turn sue the head, for allowing it to happen. We have the same thing in the UK with 3 legged races banned on school sports days, in case a child breaks their ankle. Councils are chopping down trees in the street in case someone sues them for slipping on wet leaves and hurting themselves.
