Two U.S. Border Patrol Agents have been sentenced to a
decade long prison terms for apprehending an illegal
alien at our border!

Almost as outrageous is that the illegal alien drug
smuggler, who was given immunity for testifying against
the agents is now suing the U.S. for $5 million, claiming
he was permanently injured!

I have just signed a petition calling for the President
to pardon these two Border Agents and I’m asking you to

I personally think that the prosecutor in this case shouild be fired and sent to Mexico.

I think it may have been the fact that they shot the guy in the ass while he was attempting to flee. AFTER he assaulted the two agents.

Hell, I don't really know. It's just completely absurd. If the Border Patrol can't GUARD the borders, then what's the point of them being out there?

Adding insult to injury here with the illegal alien crap... Our wonderfully run Democrat controlled Senate just voted for allowing Illegal Aliens to have access to our Social Security retirement benefits!!! What kind of crap is that!!!???

I'm still fighting, (for over 2.5 years now), for my legitimate SSD and SSI claim that SSI keeps denying even though I have an SSI Specialist Law Firm fighting for me; yet, these Illegals are going to be free and clear to get SSI retirement benefits!!!??? WTF!!!???

The first external link leads to an article in the Daily Bulletin, containing this quotes:
The agents did not report the shooting and Compean picked up his shell casings. The agents, who will be officially fired now that they have been sentenced, said in court that they thought Aldrete had a gun. They were convicted of various charges, including violating the smuggler's civil rights and tampering with evidence.

After the sentencing Thursday, U.S. Attorney Johnny Sutton said that the Border Patrol badge is not "a license to shoot people, especially unarmed suspects who are running away from you, lie to your superior and write a false report."

U.S. District Judge Kathleen Cardone said she took into account the risk to the agents in prison and the conduct of the victim when deciding on lenient sentences on most charges but that she could not reduce the 10-year mandatory, consecutive sentence mandated by federal law when a gun is discharged in the commission of a crime.

I don't know why there is this mandatory minimum of 10 years, but it's certainly not the judges fault that some lawmakers put it there (probably in the attempt to be seen as tough guys/gals).

I can only support Attorney Sutton: a uniform doesn't give you carte blanche, and definitely not for destruction of evidence.

I've done some Googling, and it's turned out to be very difficult to find anything about this from a reliable source (the shrieking from the conservative blogosphere doesn't count, but tends to drown out any other viewpoint through sheer volume), but here's the prosecution's side of the story:

Statement by US Attorney Johnny Sutton

Let me just make a couple of points.

Ramos and Compean were convicted of
* attempting to club the guy in the face with a shotgun, while he was trying to surrender
* shooting a fleeing suspect in the back
* tampering with a crime scene
* neglecting to report the incident

That is no way for law enforcement officials to behave. If they actually did these thigs, and I don't have any reason to doubt that the jury got it wrong, then I think a jail term is justified. Maybe 10+ years seems a bit harsh, but there is a reason that the upholders of the law have to be held to a higher standard.

I don't like the fact that Aldrete was given immunity from being charged with smuggling marijuana because he sounds like an absolute slimeball, but that's the way the cookie crumbles. If you've got a choice between prosecuting a known criminal or a crooked cop, surely you have to try to get the crooked cop.

Also, a lot is made of Aldrete trying to sue the US. A lot of harrumphing to the tune of "how can you let this Aldrete sue the US?" It's not a question of permitting him to do anything. As I understand it anyone is legally entitled to sue anyone for anything- he's not guaranteed success, and nobody could have prevented him anyway
